Here’s an interesting twist in the poker scandal that rocked Hollywood. The celebrity poker games that became the subject of a bunch of lawsuits are said to be bogus because, according to a famous player/director Nick Cassavertes, (the guy behind weepy chick flick The Notebook), the poker games in question were all legal.
Cassavetes filed a motion to dismiss the lawsuit filed against him to take back his winnings, on grounds California law does not consider Texas Holdem to be illegal gambling.
Cassavetes cites the California law on illegal games of chance pointing out that in California only games with house are illegal and that a game like Texas Holdem is perfectly legal as long as there is no house taking a cut or that house has the appropriate gambling permit.
In this case, there hasn’t been any stated evidence that the house had a cut (the operator has declared income from the game as tips for hosting). And since Texas Holdem is not listed among the games which are illegal in the state of California, Cassavetes might have a good chance of getting what he’s asking for, which is to have the lawsuit dismissed.
Cassavetes, along with Tobey McGuire, Leonardo DiCaprio, Ben Affleck among others, are being sued by the bankruptcy trustees of one of the players at these games, Brad Ruderman. Ruderman was convicted of running a ponzi scheme, and he allegedly used some of those ill-gotten funds to play (and lose) in the highstakes Hollywood poker games.
